1) Overview

This website is operated by Catava (A.H Freeman & S Seeton, ABN 63 399 880 476) trading as Catava Activewear (“Catava”, “we”, “us”, “our”). These Terms & Conditions (“Terms”) govern your access to and use of catavaactivewear.com and related services (the “Service”).
By visiting our site and/or purchasing from us, you agree to be bound by these Terms, our Privacy Policy, and our Shipping & Returns policies (collectively, the “Policies”). If you do not agree, please do not use the site.

Our store is hosted on Shopify, which provides our e-commerce platform.

2) Online Store Terms

  • You must be at least 16 years old (or the digital consent age in your jurisdiction) and legally able to enter into these Terms.

  • You must not use our site for unlawful purposes, infringe intellectual property rights, or introduce harmful code.

  • Breach of these Terms may result in immediate suspension or termination.

3) General Conditions

  • We may refuse service at any time for reasonable cause.

  • Non-card content you send may be transmitted unencrypted; payment card data is always encrypted by our providers.

  • You may not copy, resell, or exploit our Service without prior written consent.

4) Products, Pricing & Availability

  • Certain products or colours may be available online only, with limited quantities.

  • Colours may vary due to screen settings.

  • We may limit sales by region or order size, and adjust prices or discontinue products without notice.

  • Product quality is subject to reasonable variation; however, we aim for high standards.

5) Orders, Billing & Account Information

  • We may accept, reject, or cancel any order (e.g., due to suspected fraud or stock issues). We will attempt to notify you if this happens.

  • You must provide accurate account and billing details and keep them updated.

  • Orders placed on the AU store are charged in AUD. Any conversion fees from your bank are outside our control.

6) Contract Formation, Order Changes & Cancellations

  • A contract is formed only when you receive a shipping confirmation.

  • For changes or cancellations, email info@catavaactivewear.com immediately. Once packed or shipped, orders cannot be changed or cancelled.

  • Address errors: If you provided an incorrect address and we cannot update before dispatch, you must arrange redirection with the carrier. We are not responsible for misdelivery.

7) Pre-Orders / Launches

  • Pre-orders will display estimated dispatch dates on product pages.

  • Orders containing in-stock and pre-order items may ship together when all items are ready. For faster delivery, place separate orders.

  • Cancellations before dispatch are generally eligible for store credit.

8) Shipping & Delivery

  • Options, timeframes, and costs are listed on our Shipping page.

  • Orders placed before 10:00 AM AEST (Mon–Fri) usually dispatch the same day; others dispatch next business day. Launches or holidays may extend dispatch up to 7 days.

  • Delivery times are estimates only; delays due to carriers or customs are beyond our control.

  • If parcels are returned due to wrong address or non-collection, re-shipping costs apply.

9) Duties & Taxes (International)

  • Customers are responsible for all customs duties, taxes, or fees charged by their country.

  • If you refuse to pay and request return to sender, any return costs and fees may be deducted from your refund.

10) Returns & Exchanges

  • Returns are accepted within 30 days of delivery (see full Returns Policy).

  • Items must be unworn, unwashed, with tags attached, and in original condition. Items with odours, stains, pet hair, or signs of wear cannot be returned.

  • Certain items (e.g., underwear, socks, towels, drinkware, and final sale items) are not returnable for hygiene or promotional reasons.

  • Refunds, exchanges, and store credits are processed according to the method of payment (Afterpay/ZipPay, Apple Pay, PayPal, cards, etc.).

  • First-time customers may be eligible for a refund; handling fees and shipping costs may apply.

11) Promotions, Bundles & Discount Codes

  • Promotions and bundles are valid only for specified items and times, and cannot usually be combined with other discounts.

  • Discount codes are applied proportionally across items and are not reissued on returns unless required by law.

  • We do not offer refunds for price differences if an item goes on sale after your purchase.

12) Rewards / Loyalty

If Catava offers a rewards program, its specific terms will be published separately. Exclusive collections may be limited to members.

13) User Content & Social Media

By tagging @catava.activewear or submitting content to us, you grant Catava a non-exclusive licence to use your content (photos, videos, reviews, captions) in our marketing channels (site, emails/SMS, social).

We may adapt or feature your content to celebrate our community. You confirm you own the rights and have consent from anyone appearing in it.

14) Optional Tools & Third-Party Links

  • We may provide third-party tools “as is” without warranties; your use is subject to their terms.

  • Links to external sites are provided for convenience; we are not responsible for their content or policies.

15) Personal Information & Privacy

Personal data is handled under our Privacy Policy (available on our website).

16) Errors & Inaccuracies

We may correct errors or inaccuracies (e.g., product descriptions, pricing) and cancel affected orders if necessary.

17) Prohibited Uses

You may not use our site to:

  • Break laws or infringe IP rights

  • Harass, defame, or discriminate

  • Submit false info or upload malware

  • Scrape data without consent

  • Engage in spam, obscene, or harmful activities

18) Disclaimers & Liability

  • We do not guarantee uninterrupted or error-free service.

  • All products and services are provided “as is”, except where required by law (including Australian Consumer Law).

  • To the extent permitted, Catava and its team are not liable for indirect, incidental, or consequential losses.

19) Indemnity

You agree to indemnify Catava against claims or demands (including legal costs) from your breach of these Terms, law, or third-party rights.

20) Severability

If any term is unenforceable, the rest remain valid.

21) Termination

We may suspend or terminate your access if you breach these Terms. You may stop using the site at any time.

22) Entire Agreement & Waiver

These Terms, together with our Policies, are the full agreement. Our failure to enforce does not waive rights.

23) Governing Law

These Terms are governed by the laws of Victoria, Australia.

24) Changes to Terms

We may update these Terms at any time by posting changes here. Continued use means acceptance.
